Terms and Conditions

Below are Auckland Badminton Association’s (hereinafter referred to as ABA) Terms and Conditions for:

  1. Facility Use and Code of Conduct
  2. Platform Membership (Court Booking System)
  3. Casual Facility Users
  4. Credit Facility, Credit Notes and Refunds, and Participation
  5. Court Bookings
  6. Club Bookings
  7. Use of Promotional Materials

1. Facility Use and Customer Code of Conduct

The following policies and regulations must be observed at all times when booking courts and using ABA’s stadium. Failure to comply with these terms and conditions may result in a court hire penalty charge and/or cancellation of your membership. The ABA reserves the right to decline, amend, or cancel any court bookings and/or deny access to the stadium where there are breaches of these policies and regulations. Any disputes arising from these terms and conditions will be dealt with in accordance with ABA’s Constitution.

ABA is committed to providing a safe and enjoyable facility to its customers. It is the responsibility of the customer to follow the terms and conditions below to ensure safe usage of the facility.

1.1 Health & Safety

Any incidents, accidents, or near-miss episodes must be reported immediately or as soon as possible to the ABA office during office hours by emailing stadium@aklbadminton.com. To report a health and safety issue after hours, please contact the Pro Shop either in person at the Pro Shop outlet or by email to proshop@aklbadminton.com.

1.1.1 Use appropriate equipment to reduce and manage the risk of injury:

  1. Appropriate footwear is to be worn at all times and must be clean, non-marking indoor court shoes.
  2. Approved badminton shuttlecocks only are to be used inside the stadium. Balls or any other flying objects may not be used at any time.
  3. Wear comfortable clothing that does not restrict movement when playing badminton as this may result in injuries.
  4. During after-hours use of the stadium the customer takes full responsibility to use the facility unattended and unsupervised.
  5. ABA recommends that any person undertaking physical activity should seek medical advice first.

1.1.2 Keep the courts clear of any obstacles which may interfere with play:

  1. Remove shuttlecocks from the court area if not in use.
  2. Keep the immediate area surrounding the court(s) clear to allow for enough “run-off” space.
  3. Avoid having any other equipment on the court(s) other than racquets and shuttles.
  4. Ensure that other people present in the stadium keep clear of the court area.
  5. Always supervise young children closely. Ensure they are aware of the dangers when coming close to the court area.
  6. Remove your rubbish after using the courts. This includes used or broken shuttles.

1.1.3 Ensure the court surface is clean and dry:

  1. Customers of the facility must check the court surface before commencing play to ensure it is free from condensation that may cause the court surface to become slippery. Mops and brooms are available. Please check with ABA staff. If ABA staff are not in attendance, refer to clause 1.1.1.iv above.
  2. Customers of the facility are to check that the court surface is free from spilled water and/or perspiration.
  3. Customers of the facility are to ensure that dust is removed by use of the brooms available.
  4. If after checking the courts and eliminating hazards, the court surface remains slippery, play should be cancelled or suspended until the surface has been checked by ABA staff. If ABA staff are not in attendance, refer to clause 1.1.1.iv above.

1.1.4 Fire Evacuation:

  1. Customers of the facility must ensure they are familiar with emergency evacuation procedures as displayed around the stadium.
  2. The evacuation meeting point is at the centre of the carpark.
  3. The customer who hired the court(s) must ensure on arrival at the meeting point that everybody who was in attendance with them in the facility is accounted for.
  4. Clubs and groups using the facility must maintain a register of participants at each club/group day to ensure that all participants of the club/group day are accounted for at the meeting point.

1.2 Stadium Use & Customer Etiquette

1.2.1 The Customer in whose name the court booking was made under must be:

  1. present in the stadium at all times for the duration of the court booking period.
  2. responsible for their guests and their guest(s)’ actions, including any damage caused to the facility or to the facilities equipment, and for health and safety.
  3. responsible to report damage to the ABA office and/or the Pro Shop as soon as possible.
  4. responsible for the repair cost for any damages to ABA’s property or equipment

1.2.2 Customers are responsible for their personal property. Valuables such as jewellery and electronic devices should be left at home. ABA is not responsible for any lost property.

1.2.3 No alcohol is to be brought into the facility.

1.2.4 No alcohol purchased from ABA’s café outlet is to be brought into the court area.

1.2.5 No smoking is permitted on the premises including within 20m of any entrance/exit or ventilation of the premises.

1.2.6 Play on unlit courts is not permitted under any circumstance.

1.2.7 Customer court time is completed when the court lights shut down. Please exit the courts promptly so the next customer may begin their court time.

1.2.8 No leaning or using the glass next to courts 1 and 7 as stopping barriers.

1.2.9 No leaning or pulling on nets.

1.2.10 Respect the facility and the equipment provided. Ensure that you and your guest players do not abuse anything that has been provided for your use and enjoyment.

1.2.11 No glass is permitted in the court area.

1.2.12 Inappropriate behaviour that violates the rights of others, particularly when the behaviour is disrespectful to a person’s gender, race, age, sexual orientation, religion, national origin, disability or appearance, may result in immediate removal from the facility. Remarks that could be construed as offensive or discriminatory must always be avoided.

1.2.13 Customers are expected to treat coaches, managers, other players, officials, and spectators with all due respect regardless of age, race, creed, colour, gender or abilities.

1.2.14 Customers will not engage in any kind of unsportsmanlike behaviour towards officials, coaches, players, or spectators; such behaviour may include but may not be limited to arguing, booing, taunting, refusing to shake hands, or using profane language or gestures.

1.2.15 Players and spectators are not to engage in violent behaviour, either verbal or physical, or to encourage others to do so.

1.2.16 Information technology is not to be used to post inappropriate comments about players, clubs, club officials, or match officials that is discriminatory or offensive. Information technology includes but is not limited to email, instant messaging, text messages, phone messages, digital images and website postings (including social media sites such as Facebook, Twitter, Instagram, and blogs).

1.2.17 ABA is monitored by security cameras. Failure to comply with these rules may result in your membership or your right to access the facility being rescinded.

2. Platform Membership (Court Booking System)

There are 4 Membership Types.

  1. Affiliated Club Member: A member of an affiliated club that is registered and maintains a platform account receiving club membership court hire rates
  2. Community Members: Individual members who pay an annual membership fee and maintain a platform account receiving community membership court hire rates
  3. Non-Affiliated Group Member: A community group who receives custom court hire rates via a platform account
  4. ABA Approved Coaches: Approved coaches who provide services to ABA and receive custom court hire rates via a platform account

By completing Platform membership registration, individual customers will be deemed to have read and accepted these terms and conditions.

INDIVIDUAL MEMBERS

  1. Members may book only one court per hour.
  1. Members may book courts no more than 14 days in advance.

All types of members agree:

  1. To follow and accept the terms and conditions regarding court bookings
  2. To be kept informed with updated information from ABA
  3. To keep court booking accounts in credit.
  4. To provide and maintain true and accurate personal details on their platform court booking account.
  5. That memberships are non-transferable.

2.1 AFFILIATED CLUB MEMBERSHIPS

Members may hold only one account receiving club membership court hire rates. Any other account in the member’s name will be charged the relevant court hire rates (community member or casual hire rates).

2.2 COMMUNITY MEMBERSHIPS (Individuals)

Community memberships are renewable annually and are non-refundable.

2.3 COMMUNITY GROUP MEMBERSHIPS

The conditions applying to community group memberships will be in accordance with the memorandum of understanding (MOU) between the group and ABA.

2.4 ABA APPROVED COACHES

The conditions applying to ABA approved coaches’ memberships will be in accordance with the individual contract between the coach and ABA.

3. Casual Facility Users

  1. Casual court bookings must be paid for at the time of the booking.
  2. Casual facility users should note that the general terms and conditions set out in Section One (Facility Use and Customer Code of Conduct) apply to them.Failure to adhere to the terms and conditions may result in a refusal to allow future court bookings.
  3. Casual facility users should also note section 4.2.3 below.

4. CREDIT FACILITY, CREDIT NOTES, and PARTICIPATION

The following sets out ABA’s terms and conditions for:

  • Credit facilities
  • Program, competition and event participation (including registration)
  • Court booking cancellations, credit notes

4.1 Credit Facility, Payment of Invoices and/or fees and Participation

4.1.1 Platform Accounts and Court bookings

  • Only the following specified platform accounts or types of platform accounts may use a pre-set credit facility to book courts on account:
  1. New Zealand Badminton Federation (BNZ) Group Account
  2. All Internal Accounts
  3. All School Accounts
  4. All Club Accounts
  5. ABA Approved Coaches
  6. Any other Group account or Member account that has been pre-approved for a credit facility by either the General Manager
  • Invoices are generated for court bookings on account at the beginning of each month with the requirement that the invoice will be paid in full by the 20th of each month. Future court bookings may be cancelled should payment in full not be received.
  • Funds held in a court booking account may not be used/transferred for payment against any other type of product or service provided by ABA.
  • Funds held in a court booking account may be used/transferred for payment of a casual court booking.
  • Fund transfers between related court booking accounts may be requested.

4.1.2 Participation: Competitions and Events

  • Competitions and events are not eligible for a credit facility.
  • Online entries must be completed by the entry closing date.
  • Payment of fees is to be made prior to the closing date for registration.
  • Late entries after the entry/registration closing date will be accepted at the sole discretion of the Competitions Manager and may incur an additional fee.
  • The terms and conditions may vary for different types of competitions and events and will be specified on the individual registration forms.

4.1.3 Participation: Community Programs (all programs but not limited to After School, Satellite, Academies, Holiday programs)

  1. Community programs are not eligible for a credit facility.
  2. Payment is to be made prior to or on commencement of the program.
  3. The terms and conditions may vary for different types of programs and will be specified on the individual registration forms.
  4. PARTICIPANT REGISTRATION: Community Programs:
  • Owing to health and safety regulations, registration into the program must be completed prior to the start of the program.
  • Any participant who has not registered, regardless of whether payment has been received, and regardless of whether they intend to participate in all or only part of the program, will be unable to continue in the program.
  • Registrations can be done online via ABA’s website. ABA’s coach will be able to assist if registration difficulties are being experienced.

4.1.4 Participation Representative Programs

Representative tournament fees are to be paid in full upon selection.

To participate in the Representative program, representatives must:

  • Accept their selection into the program by signing the representative selection terms and conditions agreement, inclusive of acceptance of the cost of the program(s) and any agreed to payment terms or plan.
  • Pay fees in accordance with the signed representative selection terms and conditions agreement (inclusive of payment plans that have been agreed).

4.2 Court booking cancellations, rescheduled courts, and credit notes

4.2.1 Court booking cancellations

  • ABA does not refund for any court bookings.
  • ABA will provide a court booking credit under the following circumstances:
  • the court is cancelled within 30 minutes of making the court booking or
  • more than 24 hours before the time the court is booked for.
  • New Court bookings and any changes to bookings made less than 24 hours prior to the booking time will not be credited or rescheduled.

4.2.2 Platform Members (Club Affiliated Members, Community Members, Community Group Members and ABA Approved Coaches)

Credit account balances will not be refunded on expired community memberships that have been inactive for 12 months or more from the date of their commencement.

Refunds for credit account balances on active community memberships will not be provided.

4.2.3 Rescheduling Courts: Platform Account Holders

Courts may be rescheduled at the sole discretion of ABA and in accordance with the below criteria:

  1. A booking may be rescheduled without charge when change is made online more than 24 hours prior to the date/time of the court booking.
  2. Where ABA in their sole discretion agrees to reschedule a booking, the customer will receive a credit on their account to the value of the original court booking and a charge for the value of the rescheduled court booking.
  3. Where a rescheduled booking is at a higher value than the original court booking value and where there is insufficient credit available on the customer account, the customer is required to either: 1) pay a top-up amount on their account or 2) pay for the rescheduled court, in full, via credit card, cash or EFTPOS.
  4. Rescheduled courts fewer than 24 hours to the date/time of the court booking are not permitted. In these instances, a court may only be cancelled, without refund, and rebooked. The rebooked court is fully chargeable to the customer.

The terms and conditions set out in Section Two: Platform Membership, also apply.

4.2.4 Casual Facility Users (cancelling courts, rescheduling courts and refunds)

A casual facility user needing to cancel a court must contact the Pro Shop within 30 minutes of the time the court booking was made, or 24 hours before the time of the court booking. If the Pro Shop has not been contacted within the timeframes allowed, the customer will not be eligible to rebook a court without charge.

Where the credit criteria have been met as set out above, a casual facility user can elect to:

  • Rebook a court for the same value as the court being cancelled. i) An additional payment is required for rebooked courts at a higher value than the value of the cancelled court.
  • Hold in credit to be used for court bookings, Proshop purchases or any invoice or payments to ABA

4.2.5 Rescheduling Courts: Casual Users

Courts may be rescheduled at the sole discretion of ABA and in accordance with the below criteria:

  1. A booking may be rescheduled without charge when the change is made no less than 24 hours prior to the date/time of the court booking. i) Where ABA in their sole discretion agrees to reschedule a booking and where the rescheduled court booking is at a higher value than the original court booking value, the customer is required to pay the difference via credit card, cash or EFTPOS. ii) Where ABA in their sole discretion agrees to reschedule a booking and where the rescheduled court booking is at a lower value than the original court booking value, the customer is not refunded the difference.
  2. Rescheduling court bookings less than 24 hours to the date/time of the court booking are not permitted. In these instances, a court may only be cancelled, without refund or credit, and rebooked. The rebooked court is fully chargeable to the casual booker.
  3. All refunds will be created as a credit and available for use to book courts, Proshop purchases or any invoice or payments to ABA

4.2.6 Participation: Competitions and Events

  1. Refunds will only be considered at the sole discretion of ABA Management based on the following criteria: a) Doctors certificate for non pandemic sickness or injury provided no later than 7 days from the competition or event that is missed; b) Non-selection
  2. Refunds for any other criteria than those above will be provided at the sole discretion of ABA Management.
  3. In all cases an administration charge of $25, may be incurred.
  4. Any credit issued will not incur any charges and will be available for use to book courts, Proshop purchases or any invoice or payments to ABA
  5. Refunds are not provided for byes and defaults. The association will make every effort to ensure that byes and defaults are kept to a minimum.

4.2.7 Participation: Community Programs

  1. Refunds will be considered at the sole discretion of ABA management based on the following criterion: Doctors certificate for non pandemic sickness or injury provided no later than 7 days from the community program that is missed
  2. Refunds for any other criteria will be provided at the sole discretion of ABA Management.
  3. In all cases an administration charge of $25 may be incurred.
  4. Any credit issued will not incur any charges and will be available use to book courts, Proshop purchases or any invoice or payments to ABA

4.2.8 Participation: Representative Programs

Refunds will be considered at the sole discretion of ABA management based on the following criterion:

  1. Doctors certificate for non pandemic sickness or injury provided no later than 7 days from the community program that is missed
  2. Refunds for any other criteria will be provided at the sole discretion of ABA Management.
  3. In all cases an administration charge of $25 may be incurred.
  4. Any credit issued will not incur any charges and will be available use to book courts, Proshop purchases or any invoice or payments to ABA

For all Participation Programs, Competitions, and Events, a refund will be provided should the competition, event or program not proceed owing solely to the fault of ABA.

5. AUCKLAND BADMINTON COURT BOOKING POLICY

Priority for court bookings will be given in the following order:

  1. ABA Events: i) Tournaments ii) Representative Ties iii) School Holiday Programs iv) School Competitions v) Any other event organised or run by ABA
  2. ABA Representative Team training
  3. ABA Affiliated Clubs
  4. Schools
  5. ABA approved groups
  6. Registered members
  7. Non-registered members
  8. Casual bookings

If an ABA event exceeds the time limit of the courts booked, ABA’s event will take priority on the courts in order to complete the event in progress. The cost of any court bookings that are cancelled owing to such events will be refunded in full to the group or individual concerned.

6. CLUB BOOKINGS

The following policies apply to formally designated and approved clubs who book courts on a regular basis at the ABA stadium.

  1. There are no allocated club times available during the week
  2. Any club who wishes to apply for week days will need to do so in writing however there are no guarantees that ABA will be able to meet your requirements
  3. Any agreement allowing clubs to operate week days during on peak hours will not be charged at the standard club rate
  4. The club must abide by the number and times of the courts as agreed with ABA management. To make permanent changes to its court bookings, a club must apply in writing to ABA management at least one month prior to the change required. If there is a temporary change, ABA management must be advised in writing 5 days prior to the change.
  5. If a club has been issued with a club membership, the club membership may be used only at the designated club times i.e. the court booking times that the club has requested according to (a) above. (The membership is provided primarily to book additional courts, as required, at the time of playing). The General Manager has the right to recall or cancel the club membership if it is misused.
  6. The number of courts and times available to a club as permanent booking slots is determined by the following, with the exception of bookings at peak times when the number of courts a club requires may be limited by ABA Management to ensure fair and optimal use of the facility.
  • 12 registered members Maximum of two courts per hour
  • 13–18 registered members Maximum of three courts per hour
  • 19–24 registered members Maximum of four courts per hour
  • 25 –32 registered members Maximum of six courts per hour
  • 33–42 registered members Maximum of seven courts per hour
  • Over 42 registered members At the discretion of ABA Management.

Additional courts for clubs outside of the above criteria will be charged at a higher rate per court.

7. The number of courts a club is eligible to have as permanent booking slots is indicated by the number of players registered with ABA at that point in time: clubs are required to provide ABA with an accurate paid-up membership list biannually. The deadlines for such submissions are 1 April and 30 September each year.

8. If a club requires additional courts for a special event, they must apply in writing to ABA management at least 6 months prior to the event.

9. If a club has an outstanding account of 60 days or more, ABA management has the right to withdraw any courts booked for that club until the account is settled in full.

10. Courts cancelled within 24 hours of the booking time are non-refundable and remain payable by the club.

11. Auckland Badminton events take precedence over club bookings. The club(s) will be advised at least 14 days in advance of a change to their permanent bookings.

12. It is the responsibility of the club to ensure that their members observe the published rules of ABA and of the Auckland Badminton Stadium. Failure to observe these rules may, at the discretion of ABA management, result in the cancellation of the booking rights of the club. Please refer to section one of ABA’s terms and conditions available via the website.

7. Use of Promotional Materials

The customer hereby agrees and acknowledges that an ABA staff member or an ABA designated person shall have the right to

  • photograph and/or video record any game
  • retain such photographs or video recordings for the use of ABA or any other person or organisation to which ABA provides authority
  • distribute such photographs or video recordings to any other party
  • display such photographs or video recordings at any time and in any form (including, but not limited to, promotional displays of the organisers and/or sponsors of ABA or any similar event, social network internet sites, the website(s) of the organisers and/or sponsors of ABA)

PROVIDED THAT no such photographs or video recordings shall be used or retained for any illegal, immoral or unseemly use or purpose.

This document may be amended from time to time to ensure ABA’s outcomes continue to be met.
